US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

Legal scene

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling allegations, he was detained in federal detention.

In her order, the judge noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.

Terms of Release

The judge, who was hearing his petition to removal in a federal court, determined that he must now adhere to the terms of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.

This ruling marks a notable turn in a complicated immigration battle involving claims of mistaken imprisonment and disputed criminal associations.
